This article presents a qualitative study of a bibliographic and documentary nature, which critically analyzes the pedagogical practices for including migrant and refugee students in the final years of basic education, focusing on the context of the city of São Paulo. The discussion is structured in three complementary dimensions: normative-political, practical-pedagogical, and analytical-critical. The first examines the legal framework that guarantees the right to education, from the Federal Constitution to specific regulations such as Resolution CNE/CEB No. 1 (2020). The second systematizes, based on academic literature and institutional documents, pedagogical practices reported in schools in São Paulo for welcoming these students, such as translanguaging, cultural mediation, and interdisciplinary projects. Finally, the critical analysis reveals tensions and gaps in the implementation of these policies, highlighting the urgency of adequate teacher training, consistent language policies, and institutional investment. It concludes that inclusion requires more than legislation: it demands the transformation of school practices and the pedagogical ethos.
