The dignity of the human being has gained prominence in recent years as a fundamental principle from which rights also considered fundamental are derived. Based on the discussion provoked by Luhmann on external resources to the right in a system defined as operatively closed and cognitively open, the paper asks if the dignity of human being may occupy this functional place.
