The justice as equity of John Rawls and its implications for the affirmative action policy

Abstract

The main objective of this article is to understand what are the philosophical implications that the principles of justice as equity of John Rawls have for affirmative action policy. For that, I begin by addressing some central concepts in the theory of justice as fairness, namely, ideal theory and non-ideal theory, philosophical presuppositions that are indispensable for dealing with injustice in non-well-ordered societies. Subsequently, I investigate the importance of articulating certain political values essential to a democratic society, seeking to justify the importance of the implementation of positive measures to guarantee corrective justice, considering that there are still societies in which the principles of justice are not fulfilled strictly. Next, I will analyze the principles
of justice that can guarantee a right equal to an adequate system of rights and freedoms, as well as equal opportunities for the less privileged in society when it comes to access to social goods. Finally, I propose the idea that the philosophical presuppositions of the theory of justice as equity justify the implementation of affirmative public policies, which leads to believe that such actions make possible, through redistributive and compensatory measures, the development of a more just society.
