The commercial exchange of personal information is more important and relevant at each day, such commerce being extremely facilitated by the development of the new technologies. However, the broader access to this kind of data, despite of contributing to the right to publicity and access of information, also conflicts with the right to privacy and informational self-determination. Therefore this article analyses of the legislation currently in effect on Brazilian legal system regarding databases, especially the Federal Act 12.414/11, and the legal duties to be observed by the administrators of such databases concerning the usage of personal
information.
