This essay is an attempt to present to the academic community in general aspects of one of the most modern and important existing theories in the context of modern criminal law, namely the so-called criminal functionalism. Emerged in Germany in the early 1970s, the criminal functionalism is a theory that aims to review the elements that make up the analytical concept of crime (human conduct, typicality, anti-juridical, guilt), and the theory of punishment, based on the values of criminal policy in current society.Downloads
