Abstract

This paper’s aim is to examine some critics addressed to Jakobs’ Enemy Criminal Law theory, from the lack of personification of the human been, previously to any conviction, to the lack of respect for the fundamental rights. Therefore, will be made a critical and expositive study on the paths followed by the criminal legislators whose follow this theory and the laws created by them in the struggle against the organized crime and the conflictive aspects of the application of those laws.
