Abstract

The paper presentes a brief review of the crime of enforced disappearance under the terms of Brazilian Criminal Law. With that, it verifies that the crime of enforced disappearance of persons no have express provision in the Brazilian Law. Because of that, the Brazilian Criminal Jurisprudence has encountered difficulties, which takes place primarily in cases of extradition where the requesting State has establlished that crime. So is analyzed a court case and from it to some dogmatic aspects of this crime.

Doctorando y Magíster en Ciencias Criminales (PUCRS). Investigador del Consejo Nacional de Pesquisa Científica y Tecnológica (CNPq). Miembro de la Comisión de Derechos Humanos y del Tribunal de Ética e Disciplina de la Orden de los Abogados de Brasil (OABRS). Miembro del Consejo de la ACRIERGS. Abogado criminalista.
