The victim’s new role in criminal proceedings and the accusation assistant’

Abstract

The present article turns to the study of victims of crimes and their position within the modern criminal justice (and procedure) system, as Accusation assistant. At this point it is intended to stablish a dialogue between human dignity, from the victimal perspective, and the ways to secure that status dignitatis before the law in force in the country, more precisely performing an examination of the controversial figure of the Accusation assistant, valuable tool for insertion of victims in criminal proceedings – in cases of unconditioned public criminal action and the ones that are conditioned to the victim’s representation – along to the Public Prosecutor, adressing the thorniest issues in relation to this institute, and seeking to demonstrate the important role of the victim to the disentangling of criminal action.

João Pedro Moscoso Petek, Pontifícia Universidade Católica do Rio Grande do Sul

Advogado. Formado em Ciências Jurídicas e Sociais pela Universidade Católica do Rio Grande do Sul (2010/2). Trabalho de conclusão de curso sob o título "O novo papel da vítima no processo penal e a assistência à acusação", aprovado com nota máxima e recomendação à publicação pela banca examinadora composta pelo orientador Prof. Dr. Ney Fayet Jr., e pelos Prof. Ms. Mario Rocha Lopes Filho, e Prof. Ms. Rafael Braude Canterji. Realizou intercâmbio com mobilidade acadêmica para Roma, na Università degli Studi di Roma TRE no ano de 2008.
