The possibility of sponsorship of children and teenagers in Brazil

The Child and Adolescent Statute gives the child and adolescent the right of living in a family and in community so that they may have an environment ensuring their full development. The natural family is a priority and should be done to ensure its maintenance. Once it doesn´t have success, the extended family is the least aggressive way of replacing the natural one. Failing that, the host placement is an exceptional measure. However, if the persons profiles do not fit the adoption, these children / adolescents go to institutional care. That way, affective sponsorship comes as a possibility of giving affection to these children / teens who have little chance of adoption. In Brazil, there are few examples of jurisdictions that regulates the subject. It is Important to bring the legislation of Portugal to show how the country regulates the institute. Finally, this article points to a need of having a proposal in Brazilian law that would regulate the issue, bringing clear uniform rules and providing legal certainty to those who join the program and the possibilities awaiting an affection and care relationship.
