Social function and judicial reorganization procedure: a social function under new approach

The analysis of the enterprise social function takes into consideration the principles of the Brazilian Federal Constitution. Since 1988, , some political models, as well as economic thoughts of liberalism and interventionism, have been analyzed in order to untangle the principles defended constitutionally to establish the social function of the enterprise.
Based on that, focus is directed to the social function, discussing according to several doctrinal tendencies. The positions are examined, both as from the comparative law perspective, as well as from the national law, to demonstrate that the social function of the enterprise, according to the public interest, may be understood according to Coase’s lessons.
