The application of the “Bickering Principle” in the crimes against fauna

This article seeks to demonstrate how the criminal law has been applied to environmental offenses. Initially it can be stated, based on current legislation, that the penalties imposed for environmental offenses are too lenient. That culminates with the fact that non inhibition of the practice of such crimes. The study suggests an analysis of the application of the Bickering Principle in the judgments, from the perspective of the accumulation crimes and the Pays Polluter Principle. Finally, this paper proposes an improved analysis of criminal demands by the magistrates, giving wider consideration to the aspect of the protection of fauna.References
