Abstract

This paper presents a study about the liability for risks of development through its historical evolution and the treatment that is given to the subject in Comparative Law. The article examines the provisions of the European Directive 85/374, the national legislation that transpose this Directive to the countries that integrates the European Economic Community and the weightings presented in Green Paper about the civil liability that derive from damages provoked by defective products. The article also presents the description about some tragic cases that shows the importance of impute responsibility for risks of development, especially concerning to pharmaceutical and food products.
