Judiciary politic and electronic process: socioeconomic effectiveness

Abstract

Society today is in a whole new level known as Information Revolution or Revolution of Knowledge. This new world reality, fueled by communication technology, brings a undeniable economic and technological revolution in all institutions of the contemporary State. Advances in technology, the explosion of information and its easy access, along with the speed of communication eventually reach Justice. The judicial process is a mean of conflict resolution that, in order to best meet the needs of society, is constantly changing. The reason is that new laws have been promoting procedural changes for decades, reformulating the procedure, always with the aim of achieving greater effectiveness and expedite the provision of legal protection necessary for the administration of Justice nowadays. The computerization of the Brazilian Civil Procedure, seeking to meet the precept reasonable length of time the process, was completed with the promulgation of Law nº 11419 (2006), beginning a transition phase without precedents in the courts, in which it is intended, based on the principle of instrumentality of the forms, replacing the materialized paper process by the virtual storage in computer memory. The present study aims to demonstrate the advances promoted by the law that instituted the electronic process in Brazil and how theses change allow an improvement of legal protection, making it more effective, as our Constitution guarantees.
