RAWLS E A HERANÇA DE HOBBES: CONVERGÊNCIAS E DIVERGÊNCIAS – UM ESBOÇO

Abstract

RESUMO: Embora os problemas em Rawls e Hobbes sejam, a priori, distintos – o primeiro concerne aos princípios de justiça e o segundo a justificação do Estado – suas teorias parecem convergir sob vários aspectos. Conquanto Rawls afirme que o Leviatã é “sem dúvida a maior obra de filosofia política em língua inglesa,” não consta quais pontos influenciaram sua obra. Todavia, tanto Hobbes quanto Rawls afirmam que o consentimento pelo contrato não põe fim aos desacordos e que a função coercitiva do Estado pode limitar e constranger os efeitos oriundos desses desacordos. Além disso, podem ser percebidas convergências entre as leis hobbesianas e os princípios rawlsianos. Em suma, baseado nos referidos aspectos, o presente trabalho pretende apontar para alguns pontos convergentes e divergentes entre ambas as teorias. Palavras-chave: Contratualismo. Liberdade. Estado e sociedade. ** RAWLS AND INHERITANCE OF HOBBES: CONVERGENCES AND DIVERGENCES - AN OUTLINE ABSTRACT: Although the problems in Rawls and Hobbes are, a priori, different - the first one concerns the principles of justice and the second the justification of the State - their theories seem to converge in many aspects. While Rawls states that the Leviathan is "undoubtedly the greatest work of political philosophy in English," it is not mentioned which aspects have influenced his work. However, both Hobbes and Rawls state that consent of the contract does not put an end to disagreements and that the enforcement function of the State can limit and constrain the effects from these disagreements. Moreover, it may be perceived similarities between the hobbesian laws and the rawlsian principles. In short, based on such aspects, this work aims to point out some convergent and divergent aspects between both theories. Key Words: Contractualism. Freedom. Justification. Policy. Contract.
