Abstract

The text deals with civil disobedience as a right. Indeed, civil disobedience is understood by Habermas as one of the original rights of the sovereign. The paper reconstructs Raz’s objection that civil disobedience is not a right and takes this objection seriously in order to scrutinize some consequences that such a formulation might have for Habermas’s theory. It is argued that the version of civil disobedience sustained by Habermas can offer an answer to Raz’s objection.

Author Biography

Delamar José Volpato Dutra, Federal University of Santa Catarina, Florianópolis, Santa Catarina, Brazil.

Graduated in Philosophy (UCS) and Law (UFSC), PhD in Philosophy from UFRGS, with a doctoral internship at the Université Catholique de Louvain, Belgium. He did postdoctoral studies at Columbia University (New York), Aberystwyth University (Wales, United Kingdom) and the Università degli Studi di Padova. He is a full professor at the Federal University of Santa Catarina, working at the undergraduate level, in the postgraduate program in Philosophy. He is part of the teaching staff of the interdisciplinary professional master's degree Culture and Politics Studies at UNIFAP. Research on the foundation and application of law, especially the relationship between morals, law, human rights, politics and democracy. He published the books “Reason and consensus in Habermas”, “The discursive reformulation of Kantian morals” and “Manual of Philosophy of Law”.
