The Right to Civil Disobedience as one of the Sovereign’s Original Rights in Habermas and an attempt to Respond to Raz’s Critique

The text deals with civil disobedience as a right. Indeed, civil disobedience is understood by Habermas as one of the original rights of the sovereign. The paper reconstructs Raz’s objection that civil disobedience is not a right and takes this objection seriously in order to scrutinize some consequences that such a formulation might have for Habermas’s theory. It is argued that the version of civil disobedience sustained by Habermas can offer an answer to Raz’s objection.
