The discourse of the criminal policy on organized crime in Brazil

This study aims to analyze the organized crime phenomenon within the context of globalization and the recent political changes regarding the treatment of the new criminal modalities in Brazil. It is presented an overview of the complexity of crime and the difficulties in its definition, especially regarding the concept of criminal organization for providing a minimum legal certainty to the penal system. Further on, it is shown that the reality of the regional context is imposed as a limit to the thoughtless incorporation of models of repression to the organized crime. Finally, the research analyzes that the historicity of the criminal phenomenon prevents a stagnant conceptualization of criminal organization and that, while the global critics is not reasonable, it is not possible to lose the ability of a exempt analysis in the specific case of the real possibilities that legitimate the discipline.References
