Brazilian Penitentiary System as an index and extent of national civilization level

Abstract

The prison sentence is a necessary evil to humans, but throughout the evolution of civilization proved to be, in theory, as an alternative to less aggression would bring to who that were affected by it as a result of conviction for crimes of greater offensiveness to goods-legal criminal charges. Coupled with modern purposes of punishment, as the recovery of the convict and his subsequent return to society, can be taken as an index and measure of the degree a particular country civilization, since prison conditions are a true picture of the population opinion about of offenders, and also if the prison system follows the evolution of criminal-politics in the world. That said, what would be the level of brazilian culture if has taken as its parameter prison system? This is the question that this article will attempt to answer.

Professor Assistente-doutor de Direito Penal e Criminologia do Departamento de Direito Público da UNESP; é Coordenador do PPGDIREITO - Programa de Pós-graduação em Direito da UNESP; é presidente do Conselho Editorial da Revista de Estudos Jurídicos UNESP (2010/2013); é membro do IBCCRIM, AIDP e MMPD; e é Promotor de Justiça do MPESP. Foi membro do CONDEP/SP, representando a UNESP; e do CEAC – Conselho Editorial Acadêmico da Fundação Editora UNESP (2008/2011).

João Vitor Mello de Oliveira Guimarães, UNESP

Bacharel em Direito pela UNESP – Universidade Estadual Paulista Júlio de Mesquita Filho – Campus de Franca. Membro do grupo de pesquisa “NETPDH - Núcleo de Estudos da Tutela Penal e Educação em Direitos Humanos”. Foi bolsista de iniciação científica entre os anos de 2010-2011 da Fundação de Amparo à Pesquisa do Estado de São Paulo - FAPESP.
