Abstract

This paper seeks to analyze the problem of the philosophical-legal foundation of human rights. It states the question: to whom do Human Rights serve? Human Rights are considered the outcome of a historical victory for humanity. However, the unfolding of globalization and capitalism, particularly after the digital revolution, into savage, unbridled, total, and radical capitalism implied a situation that Marx detected almost 200 years ago: the abyss between the ways of life of two humanities. On the one hand, those who possess the means of production and exercise their citizenship within the ideological apparatus of the State, and on the other hand, the mere “abstract citizens,” the puppets who support the superstructures that perpetuate the maintenance of the status quo, which threatens the most precious asset that human beings possess: life. Thus, this article aims to critically investigate under which circumstances the hegemonic discourse that lies under human rights has established itself as a mechanism for subjectivizing and shaping contemporary societies, mainly through two institutions: freedom and private property. To achieve this goal, it will intertwine, on the one hand, an in-depth study of the fundamental principles of Hegel’s Philosophy of Law, which contributed to the consolidation of Human Rights, and, on the other hand, the critique of Human Rights as articulated by Karl Marx.

Author Biographies

Péricles Ayres Schutz, Pontifical Catholic University of Rio Grande do Sul, Porto Alegre, RS, Brazil.

He holds a degree in Law from the Pontifical Catholic University of Paraná (2019) and a lato sensu postgraduate degree in Constitutional Law from the Brazilian Academy of Constitutional Law (2021). He has a degree in Philosophy from the Pontifical Catholic University of Rio Grande do Sul (2023) and is currently studying for a master's degree at the same university with a research focus on ethics and political philosophy. He works as a CNPq researcher in the research line State and Theory of Justice coordinated by Professor Thadeu Weber, in which he addresses the problem of the “Conceptual Stylistics of Disobedience”.

Thadeu Weber, Pontifical Catholic University of Rio Grande do Sul, Porto Alegre, RS, Brazil.

He holds a degree in Philosophy from the Faculty of Philosophy of Our Lady of the Immaculate Conception (1977), a master's degree in Philosophy from the Pontifical Catholic University of Rio Grande do Sul (1980) and a PhD in Philosophy from the Federal University of Rio Grande do Sul (1992). He is currently a full professor at the Pontifical Catholic University of Rio Grande do Sul, in the postgraduate programs in Philosophy and Law and in the undergraduate program in Philosophy. He has experience in the area of ​​Philosophy, with an emphasis on Ethics and Political Philosophy, working mainly on the following themes: freedom, ethics, law, state and theories of justice.
