O Exame de DNA e sua Influência nas Ações de Investigação de Paternidade
Abstract
O presente trabalho aborda a influência do exame de DNA nas ações de investigação de paternidade, questionando e formulando posicionamentos a respeito da representatividade desse tipo de prova pericial no ordenamento jurídico brasileiro. A prova realizada através do exame de DNA como meio absoluto de determinação da paternidade e a eventual falibilidade desse exame genético são os principais entendimentos analisados. Para tanto, são, também, referidos temas como doação de espermas e reprodução assistida. A matéria é controvertida e não se encontra pacificada. Para muitos, a descoberta da genética trouxe certeza inequívoca à paternidade, no entanto, não são poucos os que alertam quanto à sacralização da prova pericial.
