Abstract

This article aims to analyze the article 1.841 that present the distinction provided by the Brazilian Civil Code in the treatment of unilateral brothers and bilateral brothers in the case of inherits of a collateral. The bilateral brothers inherit the double of the unilateral brother’s portion, that present the distinction made by the Civil Code. Some authors consider the article 1.841 as Constitutional because the bilateral brother has two blood ties and the unilateral brother has only one. However, the Brazilian Federal Constitution guarantee an equal treatment to sons without any regards. Therefore, the present research explains a possible unconstitutionality of the article 1.841 of Brazilian Civil Code facing the principle of equality.
