Abstract

Este artigo busca confrontar as funções declaradas pelo discurso jurídico penal dos Juizados Especiais Criminais, criado pela Lei 9099, de 26 de setembro de 1995, com a operacionalidade desse juizado, revelada pela pesquisa de campo realizada no Juizado Especial Criminal de Brasília. A pesquisa parte da contradição entre as funções declaradas e a operacionalidade do sistema penal. A investigação realizada no Juizado Especial de Brasília revela a contradição do juizado especial criminal que opera numa lógica de intervenção que visa ao arquivamento dos termos circunstanciados, não colocando a conciliação como uma prioridade.
