Abstract

In the contemporary context, penal practices have enhanced as a means to regulate social conflicts, which has led to the Judiciary apparatus being used in political practices with the penal field taking the core of the process. The role of the Judiciary in the processes of enhanced criminalization is crucial to the weakening of the constitutional order and the significant increase in the spaces of exception. In Brazil, such characteristics have been deepened as a way to intervene in political fight, particularly in the actions of the so-called “Operação Lava Jato”, and have as immediate consequence criminalization of politics and regression concerning the acknowledgement of rights.

Possui Graduação em Direito pela Pontifícia Universidade Católica do Rio de Janeiro (1979), Mestrado em Direito pela Pontifícia Universidade Católica do Rio de Janeiro (1984) e Doutorado em Serviço Social pela Universidade Federal do Rio de Janeiro (2001). Professor do Programa de Pós-graduação em Direito da PUC-Rio. Coordenador-Geral do Núcleo de Direitos Humanos do Departamento de Direito da Pontifícia Universidade Católica do Rio de Janeiro, Membro fundador e diretor nacional da ANDHEP (Associação Nacional de Direitos Humanos - Pesquisa e Pós-graduação); Pesquisador do CNPQ (Produtividade em Pesquisa 2 - 2009-2012; 2012-2014); Membro da Comissão da Verdade do Rio de Janeiro; Pesquisador na PUC-Rio da Cátedra Unesco "Direitos Humanos e Violência: Governo e Governança"; Ex-Diretor do Departamento de Direito da PUC-Rio (2002-2005); membro fundador da Red Latinoamericana de Derechos Humanos y Seguridad Pública ; membro do Conselho Editorial e Parecerista da Editora Lumen Juris; membro do Conselho Editorial da Federação de Órgãos para Assistência Social e Educacional; vice-presidente da Associação de Juristas Pela Integração da América Latina, membro do Instituto Carioca de Criminologia. Tem experiência acadêmica (pesquisa e docência) na área de Direito Público, Criminologia, Direitos Humanos e Sociologia Jurídica (ênfase em Direito Público).
