“State of exception”, penal populism and criminalization of politics

In the contemporary context, penal practices have enhanced as a means to regulate social conflicts, which has led to the Judiciary apparatus being used in political practices with the penal field taking the core of the process. The role of the Judiciary in the processes of enhanced criminalization is crucial to the weakening of the constitutional order and the significant increase in the spaces of exception. In Brazil, such characteristics have been deepened as a way to intervene in political fight, particularly in the actions of the so-called “Operação Lava Jato”, and have as immediate consequence criminalization of politics and regression concerning the acknowledgement of rights.
