Politicization of criminality and social vulnerability: between the paradigms of criminal justice and criminal selectivity

Abstract

The contemporary context reinforces the existence of a justice politicization process, resulting in the abandonment of the judicial character by judicial actors, who come to pursue political objectives, from the replacement of criteria relating to the legal framework for opportunity paradigms. Thus, the criminal suits in its concreteness, fall upon the most vulnerable social groups, in a vulnerability selectivity relation, which is a negative implication of the relationship between availability of material or symbolic resources and access to multiple opportunities. Political power is exercised, in general, by people who are part of the ruling stratum of society: whose interests are often ontemplated, generating losses to less advantaged social groups. This work’s objective is to explore the relationship between politics and it’s arbitrary exercise, from the criminalization of selected groups conducts, resulting from literature’s review pertaining to the issues addressed, using the dialectical method and a critical approach.
