Abstract

The prison system is marked by sexual binary. The Brazilian legal reality appears likely to overcome this model, since many states have established public policies to guarantee citizenship to transvestites and transsexuals inmates. However, these groups do not receive adequate treatment, being exposed and vulnerable before the other detainees. This work has the scope to present a critical view of the situation of transvestites and transsexuals in the prison system, focusing on the issue of gender identity, demonstrating how the current model restricts fundamental rights. This study used empirical research applied in Brazilian prisons. It analyzes the gender issue in Brazilian society, though there is a structural violence as a backdrop to the systematic violations of rights suffered by transsexuals and transvestites. Therefore, public policies will be discussed aimed at promoting respect for human dignity of these individuals entered the prison system, an institutional change is required.
