Career of indiscipline on trial: The use of drugs like element of justification to the application of juvenile imprisonment in Distrito Federal

Abstract

This paper intends to investigate how the use of drugs appears in sentences as an important category to justify the condemnation of teenagers at the juvenile criminal justice. To this end, a content analysis of seventeen judgments is made. The judges are from the TJDF, and condemned girls to a juvenile prison at the Unidade de Internação de Santa Maria-DF. To understand the act of judging this element that is not crime by itself, the theory of Michel Foucault about biopower and disciplinary society was used, but also the concept of “sujeição criminal” developed by Michel Misse. As a conclusion, it was noticed that the representations about the relationship created between “career of indiscipline” as drug use, but also the family, school and social disorganization has an affirmative role of subject in the “sujeição criminal”, that means that one who is suspected and identified with the danger.
