Media’s manufacturing of enemies and the risk for democracy: An analysis of the role played by mass media in the development and adoption of casuistic penal laws in Brazil

This article aims to analyze from a critical standpoint, the role played by mass media in the development and adoption of stiffer penal laws and it’s measures in Brazil. It is argued that the overexposure of criminal issues by the media, occurs primarily through the dissemination of punitivist speech centered around these criminal incidents, where they identify enemies to be counteracted and that this media voyeurism becomes over time an interference in the criminal law making process. To illustrate this situation, the study uses the analysis of two phenomena: the casuistry of some Brazilian legal enactments, which denotes the belief that penal intervention is the first and only response capable of resolving social conflicts (legal common sense); and the media’s manufacturing of a new social enemy, “the vandal”, after the June 2013 demonstrations.
