Um olhar crítico sobre o papel da comunidade nos processos restaurativos

O apelo à comunidade, evocado pela justiça restaurativa, existe dentro de uma paisagem mais ampla e moderna de justiça criminal, onde tem sido cada vez mais comum enfatizar a incapacidade do Estado para, sozinho, controlar o crime. Mas por que, exatamente, e como o envolvimento da comunidade deve ocorrer? O ideal comunitário é geralmente baseado em premissas ainda não verificadas empiricamente, e o presente artigo pretende questionar algumas delas. Nesse sentido, iniciaremos por identificar algumas das principais justificativas teóricas para a participação comunitária em processos restaurativos. Em seguida, mostraremos como a noção de comunidade tem sido concebida e operacionalizada em diferentes programas restaurativos. Por fim, revisitaremos os apelos comunitários que animam os restaurativistas, a fim de problematizar o papel da comunidade em práticas de justiça restaurativa. Nosso alvo, com isso, não é trazer fechamento ao debate em torno do papel da comunidade nos processos restaurativos, mas tão-somente inspirá-lo.
