Introduction to Extradition in the Brazilian legal system

Abstract

The objective is to conduct an introductory study on extradition in Brazil. For this purpose, we reviewed the main elements that compose the institute and presented the most controversial aspects, such as the issue of political crime, the role of asylum and refuge and the thesis of the duty to cooperate. This last theoretical construction proves to be important because it can improve mechanisms for extradition in order to adapt themto contemporary society. We opted for a literature review. We used national and foreign research, as well as the jurisprudence of the Supreme Court. At the end, we hope that this article will be able to encourage new research on the topic in the future.
