The European influence on German anti-terrorism law

Abstract

In contrast to the experiences of other European countries with terrorist atrocities Germany has not (yet) suffered any major attacks. Nevertheless, the threat of international terrorism led to significant changes in Germanys anti-terrorism laws. The most prominent examples are the introduction of s. 129b (“Criminal and terrorist organisations abroad“) in 2002 into the German Criminal Code, the restructuring of s. 129a (“Forming terrorist organisations“) in 2003 and, most recently, the introduction of three new offences by the “Law for the prosecution of the preparation of serious violent offences endangering the state” (GVVG) in 2009. Focusing on the latter, this article describes and analyses the major changes to substantive criminal law acknowledging the strong influence of European law.
