Criminal law in the “fight against terrorism”: Theoretical outlines from the criminalization of social movements – the case of the Movement of Landless Rural Workers

Abstract

Against the background of a symbolic case taken place in the south of the country, this paper induces a reflection on the material limits of criminal law within a Democratic State of Law, particularly in regard to crimes related to terrorism. From the perspective of the principles that guide the criminal law, indicators of the legitimacy of a State action in crime fighting, this research focuses on the lack of an adequate definition of the criminal offense related to the terrorist act.
