The parental alienation in relation to the applicability of the joint custody

This research, considering the legal innovations on the rights of children and adolescents, is engaged in the applicability of joint custody where you configure the parental alienation. The shared custody has gained more prominence as the best alternative when breaking the loving relationship between parents, to maintain the link between these and the children. However, it is also on the agenda parental alienation, which instead of promoting the right to family life of the children with their parents, ends up generating conflict situations. The issue that sought to answer was: how do the applicability of joint custody works in cases of parental alienation? The research’s overall objective was to relate the applicability of shared custody and parental alienation. The specific objectives were: to contextualize the historical evolution of family law, especially in Brazil, with the Institute of shared custody; clarify the main aspects of parental alienation, including the analysis of current legal perspectives on the subject; examine about shared custody and cases of parental alienation.
