La mediación víctima-ofensor como alternativa al sistema penal: la perspectiva de las víctimas

Uno de los debates que existen dentro de la literatura sobre la justicia restaurativa (JR) es el posible efecto que las prácticas restaurativas pueden tener sobre la víctima cuando ésta se implementa en gran cercanía con el sistema penal (esto es, cuando el resultado del encuentro restaurativo puede tener directa repercusión en el resultado judicial), como ha sido la tendencia europea en los últimos años. Académicos han planteado queen estas condiciones, la JRcorre el riesgo de enfocarse en las necesidades del ofensor, descuidando las necesidades de la víctima. Este artículo tiene como objetivo presentar y discutir los resultados de una investigación cualitativa realizada en España en la que cincuenta víctimas fueron entrevistadas antes y después de participar en mediación víctima-ofensor. En el articulo se concluye que las víctimas valoran la inserción de un espacio de diálogo dentro del proceso penal pero al mismo tiempo lo visualizan como condicionado a él.
